My Construction Mall (MyCM) - Terms and Conditions
Welcome to My Construction Mall (MyCM), a digital platform owned by AARARU Business Services (AARARU). By accessing or using our platform, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.
1. Acceptance of Terms
By using the MyCM platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our services.
2. Services Offered
MyCM is the world's first comprehensive digital platform for the purchase and sale of products, services, and assets related to the Architecture, Construction, and Real Estate (AEC) industries. This includes, but is not limited to:
Materials and equipment required for real estate development.
Buying and selling of real estate plots.
Architecture services of all kinds, including design and in-situ installation.
Services related to government approvals and processes.
MyCM acts as a facilitator, listing services and products offered by AARARU and its third-party partners.
3. User Accounts
To access certain features of the platform, you may be required to register for an account.
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4. Payments and Fees
MyCM charges a maximum 10% service fee for facilitating transactions on its platform. This fee is applied to the total transaction value.
All payments for products and services are processed through the platform. Specific payment methods will be detailed during the checkout process.
Government fees for applications are separate from MyCM's service fees. An additional fee of ₹600 will be charged for form filling and assistance per application, in addition to government fees. Customers are encouraged to visit the AARARU office for form submission.
5. Guarantee and Warranty
MyCM does not provide direct warranties or guarantees on products or services.
Warranties will be based solely on the policies of the third-party providers partnered with MyCM.
While MyCM endeavors to ensure quality checks on partnered providers, it is ultimately your responsibility to review and understand the specific warranties and guarantees offered by individual providers before making a purchase.
MyCM is not liable for any discrepancies between advertised warranties and actual service or product performance.
6. Cancellation and Refund Policy
General Policy: Once an order is accepted, cancellations are typically not allowed. Refunds may be considered under certain circumstances after the order is accepted, subject to a 15% processing fee.
Refund Eligibility: Refunds may be granted for orders that have not yet been accepted. Refunds may also be granted in cases of product defects, incorrect orders, or significant delays, subject to the general policy.
Refund Amount: Refunds will be processed for 85% of the total order value, minus any applicable fees. A 15% processing fee will be deducted to cover administrative costs.
Refund Timeline: Refunds will be processed within 7-15 business days to your original payment method or submitted bank account.
Additional Considerations: Custom orders or personalized services may have specific refund policies. Please review individual product descriptions for detailed information.
Cancellation Policy: Cancellations before order acceptance may be eligible for a full refund. Once an order is accepted, cancellation is subject to our general refund policy.
7. Return Policy
MyCM generally does not accept returns, as we ensure products reach you safely and on time.
Damaged Products: In case you receive damaged products, you must contact MyCM within 24 hours of delivery with supporting images. We will review and resolve the issue accordingly.
Customer Expectation: If products do not meet your expectation, please contact us. We will evaluate on a case-by-case basis if we can offer returns at your location at an additional charge.
Return Cost: If a return is offered, a nominal cost for picking up the product from your doorstep and delivering it back to us will be communicated to you before processing the return.
8. User Conduct
You agree not to use the MyCM platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair the platform. Prohibited activities include:
Posting false, inaccurate, misleading, or defamatory content.
Infringing on any third party's copyright, patent, trademark, trade secret, or other proprietary rights.
Distributing viruses or any other technologies that may harm MyCM or the interests or property of MyCM users.
Collecting information about users without their consent.
9. Intellectual Property
All content on the MyCM platform, including text, graphics, logos, images, and software, is the property of AARARU Business Services or its content suppliers and is protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any content without explicit written permission.
10. Disclaimers and Limitation of Liability
MyCM provides the platform "as is" and "as available." We do not guarantee that the platform will be uninterrupted, error-free, or secure.
MyCM is not responsible for the outcome of services delivered or products sold by AARARU or third-party providers. Our role is limited to facilitating transactions.
To the fullest extent permitted by law, MyCM and AARARU Business Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the platform; (b) any conduct or content of any third party on the platform; or (c) unauthorized access, use, or alteration of your transmissions or content.
11. Indemnification
You agree to indemnify, defend, and hold harmless MyCM, AARARU Business Services, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms and Conditions.
12. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of India, specifically the state of Maharashtra. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Daund, Pune District, Maharashtra, India.
13. Changes to Terms
MyCM reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the platform. It is your responsibility to review these terms periodically to stay updated. Your continued use of the platform after any modifications signifies your acceptance of the revised terms.
